Terms of Service

These terms govern your use of software and services provided by MegaSuperSoft ("we", "us", "our"), a company registered in New Zealand. By using our software or services, you agree to these terms.

Software licence

Our desktop applications (including FFFFinance) are distributed as compiled binaries. Your use of the compiled application is subject to these terms.

Where our source code is published under an open-source licence (e.g. MIT, GPL), that licence governs the source code. These terms apply to the compiled application, our services, and this website — they do not override or replace any open-source licence.

Not financial advice

FFFFinance is a personal finance tool. It is not a financial adviser, accountant, or tax consultant. Nothing in our software constitutes financial advice. You should not rely on FFFFinance as a substitute for professional financial advice. We are not registered as a financial advice provider under New Zealand law.

Your data

You own your data. We don't claim any rights over the data you create, import, or store using our software.

Because our applications are local-first, your data lives on your device. We don't have access to it, and we can't recover it for you. You are responsible for your own backups.

Third-party services

Akahu

FFFFinance can optionally connect to your bank accounts via Akahu, a third-party open banking provider. If you use this feature:

  • Your relationship with Akahu is governed by Akahu's own terms and privacy policy.
  • We are not responsible for the availability, accuracy, or completeness of data provided by Akahu.
  • We are not responsible for any actions taken by Akahu or your bank.
  • You can revoke Akahu's access at any time.

Cloudflare

This website and our download CDN are served via Cloudflare. Your use of these services is subject to Cloudflare's terms.

Availability and updates

We may release updates, modify features, or discontinue software at any time. We'll make reasonable efforts to communicate significant changes, but we don't guarantee uninterrupted availability.

Auto-update functionality, where available, will only install updates from our official distribution channels.

Limitation of liability

To the maximum extent permitted by law:

  • Our software is provided "as is" without warranty of any kind, express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our software.
  • Our total liability for any claim related to our software or services is limited to the amount you paid us in the 12 months preceding the claim (which, for free software, is zero).

New Zealand Consumer Guarantees Act

If you are a consumer as defined by the New Zealand Consumer Guarantees Act 1993, nothing in these terms limits or excludes any rights or remedies you have under that Act. Where the Act applies, it prevails over any inconsistent provision in these terms.

Acceptable use

You agree not to:

  • Use our software to violate any applicable law.
  • Reverse-engineer our compiled binaries except where permitted by law or the applicable open-source licence.
  • Misrepresent your identity or affiliation when using our services.

Termination

You can stop using our software at any time. Because your data is local, uninstalling the application is sufficient — there's no account to delete.

We reserve the right to restrict access to our online services (website, CDN, update servers) if you violate these terms.

Changes to these terms

We may update these terms from time to time. Material changes will be noted on this page with an updated effective date. Continued use of our software after changes take effect constitutes acceptance.

Governing law

These terms are governed by the laws of New Zealand. Any dispute arising under these terms is subject to the exclusive jurisdiction of the courts of New Zealand.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force and effect.
